Brief Description


Under Section 176/A (1) of the Criminal Code, a person, who regularly harasses somebody else in order to terrify him/her, or to intrude in his/her private life arbitrarily; who tries to make contact with somebody else through a telecommunication instrument or personally against his/her will, in the case of a non-serious crime, is guilty of a misdemeanor of the first degree and punishable by maximum one year prison sentence, or community service, or penalty.

(2) Any person who makes threat of personal violence or public endangerment in order to terrify somebody else is guilty of a misdemeanor of the first degree and punishable by maximum two years prison sentence, or community service, or penalty. 

(3) Any person who perpetrates harassment against

            a) his/her ex spouse or ex common-law spouse; or

            b) a person who is the child of, or under authority of, the perpetrator is punishable in the first case (1) by maximum two years prison sentence, or community service, or penalty and in the second case (2) by maximum three years prison sentence.
