The Act recognizes marital rape as an offence under the prescribed circumstances. The minimum penalty for sexual offences is eight years imprisonment and the maximum is the death sentence where the perpetrator at the time of the commission of the offence had knowledge or reasonable suspicion of being infected with the human immunodeficiency virus (HIV).
