Law No. 2006-010 of 13 December 2006 constituting the Labour Code refers to sexual harassment in the workplace in its articles 40, 41, 42 and 301. Pursuant to these articles, no employee may be punished or dismissed for having endured or refusing to endure acts of sexual harassment. In addition, any employee committing such an act is liable to disciplinary sanctions. And any act of sexual harassment triggers a liability to pay compensatory damages, to which criminal penalties may be added.
